一、请假扣工资如何算?
1、对于病假工资,用人单位可以在合同中与职工进行约定,只要不低于当地最低工资的80%就可以。根据劳动部《关于职工全年月平均工作时间和工资折算问题的通知》中的规定,职工全年月平均工作天数和工作时间分别调整为0.9天和67.4小时,可以照此折算出员工日平均工资。
2、对于事假工资,企业完全可以不支付。
3、职工请事假(含病假)期间的工资待遇,国家机关和事业单位实行照发工资的制度。企业根据职工的不同性质而实行不同的制度,企业中的工人由于享受加班加点工资待遇,所以一般在事假期间不发工资;企业中的行政人员和工程技术人员不享受加班加点工资待遇,请事假每个季度在两个工作日以内的,照发工资,超过两个工作日以上的,其超过天数不发工资。
《劳动法》第五十一条
法定节假日用人单位应当依法支付工资,即折算日工资、小时工资时不剔除国家规定的11天法定节假日。据此,日工资、小时工资的折算为:
日工资:
月工资收入÷月计薪天数
小时工资:
月工资收入÷(月计薪天数×8小时)。
月计薪天数=(365天-104天)÷12月=21.75天
二、请假工资怎么算才正确
请事假工资的计算:
本月工资=基本月工资÷21.75×本月实际工作天数。
其中,本月基本工资指正常情况下一个月的工资金额;
21.75指月计薪天数,本月实际工作天数是指除去事假的天数,本月实际一共工作了多少天。
《劳动法》第五十一条
劳动者在法定休假日和婚丧假期间以及依法参加社会活动期间,用人单位应当依法支付工资。
第四十八条
国家实行最低工资保障制度。
最低工资的具体标准由省、自治区、直辖市人民政府规定,报国务院备案。
用人单位支付劳动者的工资不得低于当地最低工资标准。
